Fired for Telling the Truth

     Dr. Geoffrey Thyne, a hydrogeologist, didn’t plan to be an expert witness for law firms. But, that’s the way it turned out shortly before he planned to retire.
     He had spent most of his career working in the oil/gas industry and then in academics. He didn’t have problems when he worked for ARCO for seven years after getting an M.S. in oceanography from the University of South Florida. However, he did have problems in academics when he tried to tell the truth.
     After five years as an assistant professor at California State University at Bakersfield, in the heart of the state’s rich oil industry, he left to become associate professor/researcher at the Colorado School of Mines (CSM), a public university with a strong reputation in engineering and applied sciences. For 10 years, he taught and did research. But in 2006, as horizontal fracking began to be the way the industry was headed, he learned that research is compromised by politics.
     That’s the year he was asked by the Oil and Gas Accountability Project (OGAP) to evaluate an EPA study about horizontal fracking. The EPA study, conducted during the Bush–Cheney administration, had claimed there were no problems with horizontal fracking, one that used millions of gallons of water, dozens of toxic chemicals, and a new procedure to extract trapped gas in narrow shales.
     “I wasn’t aware of the study, or much about fracking,” says Dr. Thyne, “but I looked at the document and said it appeared to be political.” He did say there was no data to lead to the EPA conclusions, which would eventually be used to help justify the Halliburton Loophole, which exempted the industry from numerous environmental laws. But, it was Dr. Thyne’s observation about the validity of the EPA report that upset the university’s administration.
     Research about fracking apparently upset some in the administration, one of whom was Dr. Myles W. Scoggins who had worked for Mobil and ExxonMobil for more than three decades, eventually becoming president of the International Exploration & Production and Global Exploration division and then executive vice president of ExxonMobil Production Co. before becoming CSM president in 2006. In 2014, the last year of his presidency, Dr. Scoggins received $380,000 in salary and, according to the Public Affairs Institute, about $800,000 from being on the boards of three oil and energy companies.
     A meeting with a low-level administrator resulted in an agreement that Dr. Thyne should not say that there was insufficient data in the EPA study and that he could not identify himself as from CSM in public and written statements.
     But, there was more. Dr. Thyne soon began advocating for more university research about fracking and its effects.
     This time, instead of a department head telling him never to use his university affiliation in his research and public statements, it was a university vice-president. Dr. Nigel T. Middleton, vice-president of academic affairs, told Dr. Thyne the university was dropping him to half-time employment and ordered him not to discuss fracking. Dr. Middleton also has a long history of work with the oil and gas industry.
     Dr. Thyne believes the initial protest this time came from the Colorado Oil and Gas Association (COGA). The university president for four years (2007–2011) was  on the board of directors of COGA.
     In an official public relations statement, CSM denied terminating Dr. Thyne’s employment. The university claimed Dr. Thyne left CSM solely because he had another job. However, that was a carefully-couched distortion of truth. CSM did not renew his contract after he did an interview with National Public Radio, and reiterated his position that there was insufficient data to justify EPA conclusions.
     The American Association of University Professors had wanted to take up Dr. Thyne’s case as a violation of academic freedom—“but I declined because by that time, it really seemed to be a no-win situation.”
     The next year, he became a researcher at the University of Wyoming, from where he received a Ph.D. in geology in 1991. This time, six years after he began working at the university, a comment made to a local newspaper led to his termination. The Cheyenne Tribune–Eagle had published a five-part series about fracking and water usage. He says he had told the reporter each well could use two to ten million gallons of water, but for certain wells the water used could be 350,000 to one million gallons per stage, and that there could be as many as 40 stages of drilling. The reporter took the maximum per stage, and the maximum number of stages, and noted there could be more than 40 million gallons of water used. The source of the highest possible number of gallons was unattributed. However, representatives of the industry demanded to know the source, which the newspaper’s editor revealed.
     That eventually led to Dr. Thyne being called before the university’s vice-president of government affairs and a representative from Noble Energy, who demanded he retract the highest number, a number Dr. Thyne had never given the newspaper. Like CSM, the University of Wyoming also demanded that Dr. Thyne deny that any of his comments represented the views of the University of Wyoming. Shortly after that meeting, Dr. Thyne was told, “Your services are no longer needed.” He was never told why his employment was terminated. Because Wyoming is a “right-to-work” state, there was no grievance procedure. The university could easily claim, without having to prove the truth, that there were no more research funds to justify Dr Thyne’s continued employment. the reason for not renewing Dr. Thyne’s was because, “We chose a different way to go, and really that’s all I can say.”
     Dr. Thyne’s last academic employment was in 2012. “With fracking booming, I thought there would be a lot of jobs,” he says but no one in academia had wanted him. A couple of years later, he found out why. “A friend told me to check out YouTube.” On that social network, he found a one-minute video, which he recorded in 2011, that stated human error in the fracking process can cause water pollution.
     “I’m not naive, I understand politics,” says Dr. Thyne, who acknowledges, “It’s been a difficult transition,” but one he accepts because he will not sacrifice his academic integrity for political convenience.

The Fracking Prostitutes of American Colleges (Part 3)

Among the mission statements of the University of North Dakota Department of Geology and Geological Engineering is that it “strives to develop in its engineering graduates keen insight and abilities to design an environmentally sound and sustainable future for humanity.” 

Like most college mission statements, it’s a broad and vague goal, one that may not reflect reality. The Department is one of the better ones in the country, especially in training students to work in areas of gas and oil exploration and processing. However, their training—and research by the faculty—may be tainted by an industry bias, fueled by a $14 million gift.

The Department is now the Harold Hamm School of Geology and Geological Science. Hamm, CEO of Continental Resources, the ninth largest oil producer in the United States, provided $5 million to the renamed School; his company provided an additional $5. The other $4 million came from the Industrial Commission/Oil and Gas Research Program, a merger of the state of North Dakota and several gas and oil corporations.

Continental Resources, which had revenue of $3.65 billion and a net profit of $764.2 million in 2013, had opened up the oil shale in North Dakota, site of the Bakken Shale, and is currently the top producer of oil production in the country. Continental, which uses the controversial practice of high volume hydraulic horizontal fracturing (known as fracking) to extract the oil, predicts to produce 62.5–65.5 million barrels of oil, an increase in production of 26-32 percent.

UND isn’t the only college to benefit from the oil and gas industry.

In West Virginia, Bethany College and West Liberty University signed mineral rights leases, claiming the money from royalties would help improve programs and provide for new buildings. The University of Texas at Arlington, sitting above the Barnett Shale, has 22 wells on a single pad site at the edge of campus. At Indiana State University, president Dan Bradley, a petroleum engineer who touts fracking as “a freight train on steroids,” has permitted wells and pipes on campus.  

Against significant student and community opposition, the University of Tennessee opened its 8,000 acre Cumberland Research Forest to the natural gas industry. The 20-year lease includes a $300,000 a year payment plus at least 10 percent royalties. The university stated it was entering into the agreement in order to “conduct unbiased, scientifically sound research.” However, because the research is funded by the natural gas industry, the ethical probability of a conflict of interest must be raised. If the university makes money from the industry, and a portion of that money is targeted for faculty research, how impartial can that research be?
Politicians who take substantial contributions from the oil and gas lobbyists tend to be the ones who vote against human services and education budget increases. By dangling possible income from mineral rights leases, they blur the distinction between professors and corporate shills.

Research conducted by Drs. Charles G. Groat and Thomas W. Grimshaw and a team from the Energy Institute at the University of Texas placed the primary problem of methane in well water with the construction problems in both natural gas wells and drinking water wells rather than the process itself. Dr. Groat’s study supported the industry’s claims that fracking doesn’t cause health and pollution problems.

However, the Public Accountability Initiative revealed in July 2012 that Dr. Groat was a member of the board of Plains Exploration and Production Co., which conducts fracking operations. He received an annual fee for being a member of the Board. Since November 2007, when he became a member of the Board, Dr. Groat received about $1.6 million in stock from the company. The Initiative noted that the research by Dr. Groat and his team was distinguished by “bold, definitive, industry-friendly claims highlighted in the press release but not supported by the underlying report; evidence of poor scholarship and industry bias; and dubious and inaccurate claims of peer review” that had led the media to report there was no relationship between fracking and health and pollution problems. In response, Dr. Groat said his role “was to organize [the study], coordinate the activities and report their conclusions.” He claimed he did not “alter their conclusions” and his presence on the Pioneer board had “no bearing on the results of the study.”

An independent investigation initiated by the University of Texas found “failures and inadequacies in several procedural areas,” and that the study “fell short of contemporary standards for scientific work.”

A University of Texas study, published in the Proceedings of the National Academy of Sciences in September 2013, concluded there were minimal leaks of methane from fracked wells. However, Sharon Kelly, an attorney, journalist, and long-time environmentalist who analyzed the University of Texas study for DeSmogBlog, noted: “The vast majority of the wells studied used leak-control technology that has yet to be adopted at many, if not most, oil and gas wells, while others were wells that produced very little gas and consequently even serious leaks would produce relatively small emissions.” Physicians Scientists & Engineers for Healthy Energy (PSE) determined the study was “fatally flawed.”

Horizontal fracking to extract shale gas “is a wonderful gift that has arrived just in time,” say Dr. Richard Muller, professor of physics at the University of California, and his daughter, Elizabeth Muller, executive director of Berkeley Earth. The Mullers argue, “Environmentalists should recognize the shale gas revolution as beneficial to society and lend their full support to helping it advance.” The Mullers are principals of the China Shale Fund, which is trying to get China to develop shale gas drilling; they would get financial compensation if China moves from coal to shale gas technology.

The natural gas industry needs to “seek out academic studies and champion with universities—because that again provides tremendous credibility to the overall process,” said S. Dennis Holbrook, an executive with Norse Energy and a member of the board of directors of the Independent Oil and Gas Association of New York (IOGA). One of the ways IOGA helped direct academic research is by its connection to SUNY’s Shale Resources and Society Institute (SRSI), which sponsored lectures, workshops, and professional studies. Among those research studies was one paper where “[A]ll four co-authors had ties to the oil and gas industry, as did four of five of its peer reviewers,” according to Steve Horn of DeSmogBlog.

An informal group of faculty, students, alumni and citizens stated that the Institute and the research emanating from it were not only “fatally compromised,” but that it represented “not the independent search for knowledge proper to a university but a frantic and servile willingness to sell academic legitimacy to a public relations campaign for the gas industry.” The Public Accountability Project analyzed the SUNY/ Buffalo study and “identified a number of problems that undermine its conclusion.” In November 2012, six months after the Institute was created, SUNY/Buffalo closed it.

Several other research studies conducted at American universities and funded by either gas/oil companies or their front organizations allowed Barry Russell, president of the Independent Petroleum Association of America, to falsely claim, “no evidence directly connects injection of fracking fluid into shale with aquifer contamination.”

It makes little difference if the Community College of Philadelphia accepted “only” $15,000, Lackawanna College accepted $2.5 million, or the University of North Dakota accepted $14 million. We know what they have become—it’s just a matter of deciding how much a tainted body of knowledge is worth.

The Mugging of SpongeBob SquarePants

            SpongeBob SquarePants may be hazardous to your mental development—if you're a four-year-old. At least that's what two psychologists at the University of Virginia claim, based upon a study they conducted that may have as many holes as the average sponge who lives under the sea.
            In the first paragraph of an article published this week in the academic journal Pediatrics, Angeline S. Lilliard and Jennifer Peterson set up their study with a pick-and-choose somewhat slanted view of television. According to these psychologists, "correlational studies link early television viewing with deficits in executive function . .  . a collection of prefrontal skills underlying goal-directed behavior, including attention, working memory, inhibitory control, problem solving, self-regulation, and delay of gratification." Translated into English, we conclude that psychologists don't speak English.
            To make sure no one misreads the study as anything but pure empirical science, they toss in "covariant assessment," "covariate," "posthoc analyses," "backward digit span," "encoding," "cognitive depletion," and something known as the "Tower of Hanoi," not to be mistaken, apparently, for the Hanoi Hilton, or the Tower of Babel, which this study seems most likely to emulate.
            For their subject group, they rounded up four-year-olds from "a database of families willing to participate." Three groups of children were given the same four separate tasks. Those who watched a truncated version of a "SpongeBob" cartoon, which has scene changes an average of every 11 seconds, fared worse in the measurements than did the groups that watched a more "realistic" and "educational" PBS cartoon ("Caillou") that had an average scene change of 34 seconds. The third group (known as a "control" group) drew things and participated in all the tasks. On all four tests, "SpongeBob" lost. The fact the researchers labeled "Caillou" as educational could reveal pre-conceived bias; even a cursory look at "SpongeBob," although primarily entertainment, reveals numerous social and educational issues that could lead to further discussion.
            The pre-schoolers were mostly White, from middle-class and upper-class families. Thus, there was no randomly-selected group, something critical in most such studies. The researchers do acknowledge this, as well as a few defects in the study itself. Possibly salivating over future grants, they tell us that "further research . . . is needed."
            The reality may not be that four-year-olds who watch "SpongeBob" and similar cartoons had developmental defects but that they are far more interested in the cartoon than in other activities and temporarily suspend those "good quality" activities while they remember the cartoon and think of other events or issues that SpongeBob and the cast got into. The researchers measured the students' responses shortly after watching the cartoons; perhaps measurements a few hours or a week later might have given different results.
            Nevertheless, the researchers—hung up on standard deviations, regression analysis, and Cronbach's Alpha, among other empirical tests—didn't do the most basic of all research. They didn't ask the children what they thought about the cartoons, nor any questions leading to why the children who viewed "SpongeBob" may not have performed as well the other two groups on tests that may or may not be of value. It's entirely possible that watching fast-paced well-written tightly-directed animated cartoons may be more fun—and more productive—than watching slower-paced educational cartoons. But we don't know because the research was quantified.
            The wounded response by Nickelodeon, which airs "SpongeBob Squarepants," isn't much better than the academic study. Squeezed into a sentence, the comment is that the cartoon is for 6–11 year olds, not the four-year-olds who were tested. The Nick PR machine wants us to believe that even if everything the researchers said was true, it doesn't matter because the cartoon isn't aimed at four-year-olds.  Apparently, even if older siblings are watching "SpongeBob" or their parents are watching horror, adventure, or war movies it doesn't matter because those forms of entertainment aren't for four-year-olds.
            For more than eight decades, animated cartoons have come under fire by all kinds of academic researchers and certain "we-do-good" public groups. From 1930 to 1968, the Hays office, ensconced in Puritan ideals of morality, censored films and cartoons for all kinds of reasons. By the 1960s, academic researchers began questioning the violence in cartoons, focusing primarily upon the Warner Brothers characters. For a few years, television programmers, either believing themselves to be great pillars of morality or afraid of losing sponsors, forcibly retired many of the most popular cartoons from the screen.
            At least half of the studies concluded that watching violence could be one of the factors that lead to violent acts. Another group of studies showed little correlation. But, stripping away the academic verbiage, the most logical conclusion of all the studies that denuded a small forest was that persons pre-disposed to violence may become violent if exposed to violence in cartoons. Certainly, watching Roadrunner/Wile E. Coyote cartoons won't cause a Quaker to go out and mug Baptists.
            The mugging that SpongeBob (and other characters in quick-sequencing action) got is another attempt to quantify life by exorcizing a small part of life, running tests, and trying to explain human cognition and development without understanding humans.
